DEFINITIONS:

Following words shall for the purpose of these terms and conditions, be defined to mean as below: “BFL” refers to Bajaj Finance Limited. “Customer” means an Indian citizen who avails a loan from BFL during the Offer Period. “Offer Period” shall mean the period commencing from 10:00 am on Oct 10, 2018 to 11:59 pm on Nov 15, 2018. “Participating Store(s)” shall mean such dealer stores, retail outlets which are empaneled with BFL and is verified by VIVO in connection with purchase of Products by the Customer and are participating in this Promotion and are specifically listed in Annexure A, below. Link for the same: https://www.bajajfinserv.in/store-locator “Product” shall mean selected Smartphone of participating brands, specifically listed in Annexure B, below “Promotion” shall mean the “Sparkling Diwali - 2018” promotional program offered by BFL for its Customers during the Offer Period. “Reward” refers to reward offered to the Winner(s) under the applicable Scheme. “Scheme” shall mean the various promotional schemes as stated in clause 3 of these terms and conditions “Website” means BFL’s website at the following URL https://www.bajajfinserv.in/finance/ “Winner” means a Customer who has been declared as a winner by BFL under this Promotion.
To participate in this Promotion and to avail the Rewards under this Schemes, the Customer should have mandatorily availed a loan from BFL for purchasing select Product(s) from the Participating Store(s), during the Offer Period.
As part of the Promotion, the Winners may be selected from the eligible and participating Customers who have successfully met all the criteria specified by BFL, under any of the following Schemes as stated below:
(a) Scheme : Under this Scheme, BFL will select Winners who will be eligible for cashback in Bajaj Finserv-Mobikwik Wallet (“Wallet”) based on the following criteria:
- Minimum Assured Cashback of ₹500 to every Customer
- Assured Cashback of 11% of Product price for every 11th Customer during the Offer Period.
- Assured Cashback of 100% of Product price for every 110th Customer during the Offer Period.
All the Rewards are assured rewards for all eligible and participating Customers. The Customer will get instant notification of the cashback amount. The Customer will be sent a link to download the Wallet which will reflect the cashback amount rewarded to such Customer.
In case where the Customer is eligible for more than one cashback Reward under this Promotion, than he/she shall only be eligible to receive the higher amount of cashback earned as per terms of this Promotion.
The Winners shall be eligible for the Reward only upon payment of the first three (3) equated monthly instalment (EMI) payable to BFL for the loan availed under this Promotion.
This Promotion is available only in select cities of India and is valid only for Indian citizens. This Promotion is not applicable in places wherever prohibited and / or on gifts / services for which such offers cannot be made available for any reason whatsoever. For the avoidance of doubt, it is hereby clarified that this Promotion is not applicable to the Customers in the state of Tamil Nadu.
The Schemes and the Rewards are available at the sole discretion of BFL and subject to changes/discontinuance as deemed fit by BFL, without any prior notice.
Participating in this Promotion is voluntary and the Customer is not bound to participate in this Promotion. There is no compensation for non-participation in the Promotion under any circumstances whatsoever.
This Promotion cannot be combined with any other offer/discount/promotion of BFL, including but not limited to the EMI Card offers available at the merchant and/or dealer outlets.
Images of the products shown on email, BFL’s website or any other advertisement material whatsoever, are for representational purpose only. Notwithstanding anything contained in the Promotion or these terms and conditions, any images, representations etc. and all intellectual property rights pertaining thereto which belong to any third party, shall continue to vest with such party and by using such images, representations etc., BFL in no way claims any right whatsoever relating to such intellectual property.
The decision of BFL selection committee in selecting the Winners eligible for a Reward will be final and binding on the participating Customers. Such Winners will be contacted by BFL after the expiry of the Offer Period either through email, telephonic call, SMS or wallet notification on the Customer’s registered email address/contact number and will be communicated the details for the collection of the Reward.
In case of default in the payment of first three (3) EMIs or cancellation/refund of the qualifying loan transaction, the Winner shall no longer be eligible to receive the Reward under this Promotion.
Where the Winner has provided any incorrect information at the time of registration for the Promotion and/or at the time of collecting his/her Reward, then his/her selection is subject to cancellation without notice, at the sole discretion of BFL.
All applicable taxes, fees and levies (excluding ‘gift’ tax or tax deducted at source, where applicable) will need to be solely paid by the Winner(s) and proof of other documents, as required, will need to be necessarily produced before taking possession of the Reward (s).
The tax deducted at source in respect of the Reward, where applicable, shall be paid by BFL.
This Promotion is a special offer for BFL Customers only and nothing contained herein shall prejudice or affect the terms and conditions of the EMI Card and/or Customer loan agreements. These terms and conditions shall be in addition to and not in derogation to the terms and conditions prescribed by BFL for the loan and/or EMI Card.
The usage of Rewards shall be governed by the applicable terms and conditions governing the Reward which will be in addition to these terms and condition. BFL shall have no responsibility whatsoever in connection with the usage of the Reward.
BFL is not a supplier/manufacturer/issuer of the products purchased by Customer provided to the Winners under this Promotion and will not accept any liability in relation thereto. Accordingly, BFL shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the products provided by third parties.
Notwithstanding anything herein, BFL shall not at any time be responsible or held liable for any loss, injury, damage or harm suffered by or in connection with the products or Rewards provided by third parties.
Disputes, if any, regarding the products/services under the Promotion must be addressed in writing, by the Customers directly to the Participating Store and BFL shall not entertain any communication in this regard.
BFL's decision on all matters relating to the Promotion/Scheme will be at its absolute discretion and will be final and binding on all participants.
BFL reserves the right to revise these terms, modify or withdraw this Promotion at any time without prior notice or reason. These terms and conditions prevail over the contents of any brochure or other promotional material advertising the Promotion.
BFL, its group entities/ affiliates or their respective directors, officers, employees, agents, vendors, etc., shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered by a Customer, directly or indirectly, including for reasons arising out of use or non-use of products/ services/Rewards or participation under this Promotion.
BFL shall not be liable for termination or delay of the Promotion or the Rewards forming part of the Promotion due to any force majeure event and will not be liable for any consequences.
The Promotion is not transferable, non-negotiable and cannot be encashed under any circumstances.
These terms and conditions shall be governed by the laws of India. All disputes if any arising out of or in conjunction with or as a result of this Promotion or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts in Pune only. The existence of a dispute, if any, shall not constitute a claim against BFL.
This Promotion is subject to laws, rules and regulations as may be applicable in any jurisdiction in India, from time to time, and accordingly in places where not permissible shall be deemed as not applicable.
The Customers agree to be bound by the terms and conditions contained herein. Without a Customer being required to do any further act, the Customers shall be deemed to have read, understood and unconditionally accepted the terms and conditions herein.
