V25 Series #ForPicturePerfectNights Terms and Conditions

V25 Series #ForPicturePerfectNights is a vivo photography IP that is operated by vivo’s social media team. It is a platform for all vivo users to share great creative works with the uses of this filter.

To participate in V25 Series #ForPicturePerfectNights events (the “Contest”), please follow the instructions and read the following terms and conditions carefully. Your participation will be deemed as acceptance of the terms and conditions, which will form a binding agreement between you (the “Participant”) and vivo Mobile Communication Co., Ltd. (the “Promoter” or “vivo”)

How to Participate

1.1. By participating in the Contest, you hereby accept these participation rules (referred to hereafter as "the Rules"). If you do not wish to accept these Rules, please do not enter.

1.2. The Participant must be a registered member of Instagram. The account must be made public so the submission is visible to the Promoter.

1.3. In order to join the campaign, the Participant must share entries with the use of appointed AR filter on Instagram with V25 Series #ForPicturePerfectNights hashtag.

1.4. To qualify for participation in the Contest, you must be over 18 years of age and enjoy full capacity for civil conduct. If under 18 years of age, you must first obtain permission from a parent or legal guardian.

1.5. The Contest details form part of the Rules.

Rules of Participation

2.1. Sharing photos on Instagram with the exclusive hashtag will enable Participants to join the Contest. If you are a vivo user, please add the hashtag #shotonvivo as well. For non-vivo users, we have a public category for entries that are not shot on vivo devices. Hence the need to only use the contest hashtag, and not #shotonvivo.
Note: All photos MUST be taken by smartphones.

2.2. Each Participant can win a maximum of one prize for the giveaway.

2.3. Entry to this Contest is free of charge and is open to all countries and regions. You understand and agree that not all the giveaways can be delivered successfully due to the requirement of applicable laws or logistical problems in certain countries or regions. In such an event, vivo shall have the right to suspend such giveaways without any legal liabilities.

2.4. The Promoter is not responsible for entries to the Contest that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, or incomplete, for any reason whatsoever, will not be eligible.

2.5. By entering, Participants warrant and represent the following:(a) each Participant shall ensure that the entries possess independent, complete, defined and uncontroversial copyright; (b) The entries shall not contain any content that violates or infringes on any rights of any other party, including but not limited to copyright, name rights, trademark rights, portrait rights, privacy rights and other legal rights; (c) any third parties appearing in the submitted entries have given Participants appropriate consent to be photographed and used as permitted herein; (d) submitted entries shall not violate any applicable laws and regulations, social ethics, public order and good customs.

2.6. Participants’ submitted photos/videos must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, sexual, profane, tortuous, slanderous, discriminatory, or promotes hatred or harm against any group or person, contain any illegal information of a political, pornographic, or violent nature or which may be deemed to support terrorism, include any disparaging remarks relating to vivo or a third party, or is disruptive to public social order and morality or otherwise does not comply with the theme and spirit of this Contest, as the Promoter may deem in its sole discretion.

2.7 If any entry has any of the aforementioned situations, vivo reserves the right to disqualify the entry and to cancel all related rights and qualifications.

Terms of Selection and the Winner of Check

3.1 vivo will choose 2 awardees from all Participants (vivo users and public entries), and post them on Instagram story for announcement.

3.2. The prize will announce on social content. Please pay attention to vivo Instagram account @vivo_global

3.3. Please pay attention to vivo’s Instagram Stories. The official vivo global account will contact you directly through Instagram’s messaging system. Please check your messages frequently to avoid missing out! If you fail to reply within 72 hours, we will consider this as a waiver.

3.4. In cases where a prize cannot be delivered due to causes originating with the winner (including but not limited to failure to provide contact information, submission of incomplete or inaccurate contact information that prevents the Promoter from establishing contact) the prize will automatically be considered waived. The Promoter assumes no responsibility for any such outcome and will not reissue the prize in such cases.

3.5. Prizes may not be exchanged for cash. If unforeseen circumstances prevent the distribution of a prize, the Promoter reserves the right to issue an equivalent prize in its place. Replacement awards may not be exchanged for cash.

3.6. Prize recipients shall bear full responsibility for any personal income taxes incurred with their prizes. The Promoter shall bear full responsibility for any domestic or international shipping charges incurred by the delivery of the prize.

3.7. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

3.8. Providing a submitted entries constitutes the Participant’s consent to authorize the Promoter a royalty-free, irrevocable, non-exclusive license to use, reproduce, publish and display such entries in whole or in part, on a worldwide basis, in any form, media for one year. The Promoter will not further notify the participants or obtain their consent when using the entries reasonably.

3.9. Participating in this Contest means that Participants agree with all these Terms and Conditions. If Participants do not agree to the relevant Rules and authorized content, please do not participate in the Contest. In addition, in case that any adverse consequences such as disqualification from the Contest or legal dispute arise from the breach of the Terms and Conditions by any of the participants, he or she shall undertake all liabilities by him or herself, and the Promoter disclaims any and all liability.

Details to the Rules

4.1. Each Participant can submit more than one entry, but one entry per post, with the required hashtags.

4.2. Using V25 Series #ForPicturePerfectNights hashtag will not impact the winner selection process. However, please appreciate the fact that it is our way of differentiating entries between vivo and public users.

4.3. Some vivo products are not launched in specific countries. If the products are not available in your country, we will deliver the prize to you that we promised in the beginning of the campaigns. However, vivo stores in your country will not be able to provide after-sales service for the products which are not launched in your country.

Privacy and Personal Information Policy

5.1. Personal information collected from each winner will be used by the Promoter for the purpose of delivering their prize. After the delivery is completed, the Promoter will delete all the personal information. The Promoter will not share or otherwise disclose personal information of winners with third parties, other than to third parties engaged by the Promoter to fulfill the above purposes.
